These Terms of Service ("Terms") govern your access to and use of the website scanning service provided by SiteScanReport LLC ("SiteScanReport," "we," "us," or "our") at sitescanreport.com (the "Service"). By using the Service or purchasing a scan, you agree to these Terms. If you do not agree, do not use the Service.
1. The Service
SiteScanReport provides automated website scanning. When you submit a URL and complete a purchase, our systems scan the target website and generate a PDF report covering automated accessibility indicators relevant to WCAG/ADA review, privacy mechanism detection, and security configuration analysis. Reports are delivered to the email address you provide at checkout. To the extent any report includes summaries, descriptions, prioritizations, explanations, recommendations, or other narrative text generated or assisted by automated or AI-based systems, that narrative is provided solely for general informational convenience, may simplify or omit relevant context, and should not be treated as a complete, definitive, or independently verified statement of fact, law, risk, or required remediation. You remain solely responsible for reviewing the report in full and for making all decisions regarding investigation, prioritization, remediation, disclosure, escalation, legal review, and ongoing compliance or security measures.
We also offer a free scan, a limited automated preview of a website's accessibility, privacy, and security signals, offered at no charge. Your use of the free scan is governed by our Free Scan Terms, which add to and do not replace these Terms. We may offer additional services in the future, including a Monitoring service that is not yet available for purchase. Where any such service is offered, it will be governed by its own separate terms presented at that time, and nothing on the site describing a service as "coming soon" is an offer to sell it or a commitment to any feature, price, or availability date.
The Service is an automated informational tool, not a legal determination. Reports reflect automated analysis performed on a specific date and only on the publicly accessible website content and configurations our systems are able to detect at that time. They are not compliance certifications, legal opinions, regulatory filings, human accessibility audits, penetration tests, or comprehensive security assessments. They also are not a substitute for legal counsel, manual accessibility review, professional security review, engineering judgment, or your own internal decision-making regarding remediation or risk acceptance. 2. Eligibility and Authority
You must be at least 18 years of age to use the Service. By submitting a URL for scanning, whether for a paid scan or a free scan, you represent and warrant that:
- You own the website at the submitted URL, or you have express authorization from the website owner to conduct a scan of that URL.
- Your use of the Service does not violate any applicable law or the rights of any third party.
- The information you provide at checkout (including your email address) is accurate.
SiteScanReport does not independently verify ownership or authorization. Responsibility for ensuring you have the right to scan a submitted URL rests entirely with you. Your obligations regarding authorization are described further in our Acceptable Use Policy and, for the free scan, in our Free Scan Terms.
3. Purchases and Payment
3.1 Pricing. The current price for a website scan is displayed at checkout prior to purchase. Prices are in U.S. dollars. We reserve the right to change pricing at any time; changes do not affect orders already placed.
3.2 Payment Processing. All payments are processed by Stripe, Inc. on our behalf on a Stripe-hosted checkout page. By completing a purchase, you also agree to Stripe's Terms of Service and Privacy Policy. We do not store your payment card information.
3.3 One-Time Purchase. Each scan is a one-time purchase. You are purchasing a single scan of the submitted URL at the time of purchase. Purchasing a scan does not create an ongoing subscription or entitle you to future scans at any price.
3.4 Free Scan and Customer Portal. The free scan is provided at no charge and requires no purchase, subject to the Free Scan Terms. When you purchase a scan, you may access a customer portal to re-download your report and view your order during the retention period described in our Privacy Policy. Access to the portal is provided as a convenience and does not extend the scope of what you purchased or entitle you to additional scans.
4. Refunds
Our full refund terms are set out in our Refund Policy, which forms part of these Terms. In summary:
4.1 Automatic Refund on Failure. If your scan fails to complete and no report is delivered, you will receive a full automatic refund to your original payment method. You do not need to contact us; the refund is processed automatically. Refunds may take 5 to 10 business days to appear depending on your card issuer.
4.2 Satisfaction Refund Window. If your report is delivered but you are not satisfied with the Service for any reason, you may request a full refund within 7 days after delivery of the report by emailing support@sitescanreport.com from the email address used at checkout. We reply within two business days and will process approved requests to your original payment method. After 7 days from delivery of the report, purchases are non-refundable.
4.3 Scope Limitations. Outside the 7-day refund window, refunds are not issued solely because a report identifies fewer issues than you expected or because your website receives a favorable grade or finding. The value of the Service is the information provided, not any particular outcome.
5. Acceptable Use
You agree to use the Service only in compliance with these Terms and our Acceptable Use Policy. Without limiting the restrictions in the Acceptable Use Policy, you agree not to use the Service to:
- Scan websites you do not own or do not have authorization to scan.
- Conduct unauthorized security testing, probing, scraping, monitoring, or reconnaissance of any website, application, network, or system, or use the Service as a substitute for permission-based security testing.
- Attempt to circumvent rate limits or access controls, abuse the free scan or any other free or promotional feature, use bots or other automation to overload or misuse the Service, or otherwise interfere with the operation, security, or availability of the Service.
- Resell, sublicense, white-label, commercialize, redistribute, or republish the Service or any scan report in a misleading manner or without our prior written consent; provided, however, that you may share a report with your client or customer in the ordinary course of a bona fide professional engagement so long as you do not misrepresent the source, nature, limitations, or intended use of the report.
- Use the Service for any unlawful purpose or in violation of any applicable regulation.
We may investigate suspected violations of these Terms or our Acceptable Use Policy and, if we determine that a violation has occurred or is likely to occur, we may take any action we deem appropriate, with or without prior notice and in addition to any remedies available under these Terms or applicable law, including refusing service, canceling or reversing orders, suspending or blocking access to the Service, and denying refunds where abuse, unauthorized use, or another violation is confirmed.
6. Intellectual Property
6.1 Our Property. The Service, including the scanning technology, report format, and all associated software, is owned by SiteScanReport LLC and protected by applicable intellectual property law. These Terms do not transfer any ownership rights to you.
6.2 Your Report. Upon delivery and full payment, you may use the PDF report generated for your scan for your internal purposes and may share it with advisors, clients, or customers in connection with a bona fide internal or professional engagement. During the retention period described in our Privacy Policy, you may also re-download your report from the customer portal. You may not alter, excerpt, obscure, remove, or present the report or any disclaimer or source-identifying information in a misleading way, or represent the report as having been produced by a human accessibility auditor, law firm, certified compliance professional, certified security assessor, or regulatory body, or as constituting legal advice, legal sufficiency, a compliance certification, or a guarantee of compliance or security. If you share a report with any third party, you are responsible for the manner in which you present it and for ensuring that any such third party understands the report's automated nature, limitations, and date-specific scope.
7. Disclaimers
The Service provides automated analysis only. Automated testing can detect only certain accessibility issues and indicators, including only those portions of WCAG 2.1 and 2.2 Level AA success criteria that can be evaluated by software based on the publicly accessible content and code our systems are able to detect at the time of the scan. Many accessibility issues require manual testing, assistive-technology testing, user testing, and human judgment by a qualified specialist. A report showing no detected violations does not mean your website is fully accessible or compliant with WCAG, the ADA, or any other accessibility law, regulation, or standard, and should not be used as the sole basis for remediation, certification, litigation strategy, procurement, or regulatory representations.
Reports are not legal advice. Nothing in a SiteScanReport report or in the Service constitutes legal advice, a legal opinion, legal representation, or a representation or assurance that your website complies with any law, regulation, settlement obligation, or standard. SiteScanReport LLC is a technology company, not a law firm. Any summaries, explanations, labels, risk descriptions, or suggested next steps included in a report, whether generated automatically or with AI assistance, are informational only and are not legal analysis or legal conclusions.
Reports are not compliance certifications. We do not certify, attest, warrant, or guarantee that any website is compliant with the ADA, Section 508, WCAG, GDPR, CCPA, or any other law, regulation, or standard. Any references in a report to those frameworks are provided for informational purposes only and should not be characterized as a certification, attestation, legal conclusion, or substitute for legal review or expert manual assessment. You remain solely responsible for determining what remediation, policy changes, disclosures, notices, consents, operational measures, or legal review may be appropriate in light of the report.
Reports are not security assessments. Our security analysis is limited to selected externally observable indicators, including HTTP response header configuration and SSL/TLS certificate setup. It is not a penetration test, vulnerability assessment, exploitability analysis, application code review, architecture review, or infrastructure audit. A strong security grade means proper configuration on the items we measure at the time of the scan; it does not certify the absence of vulnerabilities, incidents, or broader security weaknesses. You remain solely responsible for evaluating and deciding whether to investigate, remediate, patch, disclose, accept, transfer, or otherwise respond to any security-related finding or risk.
Impaired scans are labeled, never reported as an all-clear. When our systems cannot fully read a site, for example because a bot-protection or challenge page blocks access, the affected portion of the report is labeled as unverified ("couldn't verify") rather than reported as passing. A verified condition that raises risk still raises it; only the reassuring result is withheld where we could not confirm it.
Findings reflect conditions at the time of scanning. Websites, code, content, headers, third-party scripts, consent tools, and configurations change over time. A report produced on a given date reflects only the conditions our systems detected on that date and should not be relied on as a statement about future, continuous, or ongoing compliance, accessibility, privacy posture, or security.
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY, OR COMPLETENESS. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE, THAT ANY PARTICULAR FINDING, ISSUE, VULNERABILITY, OR COMPLIANCE DEFICIENCY WILL BE IDENTIFIED OR NOT IDENTIFIED BY OUR SCANNING TOOLS, OR THAT ANY REPORT WILL SATISFY YOUR LEGAL, REGULATORY, CUSTOMER, INSURER, OR PROCUREMENT REQUIREMENTS OR SERVE AS THE SOLE BASIS FOR ANY REMEDIATION, DISCLOSURE, CERTIFICATION, OR RISK DECISION.
8. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, SITESCANREPORT LLC, ITS MEMBERS, OFFICERS, EMPLOYEES, AGENTS, AND SERVICE PROVIDERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, BUSINESS, OPPORTUNITY, DATA, GOODWILL, OR BUSINESS INTERRUPTION, ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE, INCLUDING YOUR USE OF, INABILITY TO USE, OR RELIANCE ON THE SERVICE OR ANY REPORT, OR ANY DECISION TO REMEDIATE, NOT REMEDIATE, DISCLOSE, NOT DISCLOSE, ESCALATE, NOT ESCALATE, CERTIFY, OR OTHERWISE ACT OR FAIL TO ACT BASED ON ANY REPORT, WHETHER THE CLAIM IS BASED IN CONTRACT, TORT, STRICT LIABILITY, OR ANY OTHER LEGAL THEORY, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, OUR TOTAL CUMULATIVE LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE WILL NOT EXCEED THE AMOUNT YOU PAID US FOR THE SPECIFIC SCAN GIVING RISE TO THE CLAIM. Your use of the free scan is additionally subject to the limitation of liability in the Free Scan Terms.
Some jurisdictions do not allow the exclusion or limitation of certain damages. In those jurisdictions, our liability is limited to the greatest extent permitted by law.
9. Indemnification
You agree to indemnify, defend, and hold harmless SiteScanReport LLC and its members, officers, employees, agents, and service providers from and against any third-party claims, liabilities, damages, losses, judgments, penalties, fines, and expenses (including reasonable attorneys' fees) arising out of or related to: (a) your use or misuse of the Service; (b) your violation of these Terms or our Acceptable Use Policy; (c) your submission of, or authorization of the scanning of, any website without proper authority, permission, or consent; (d) your use, sharing, republication, alteration, or mischaracterization of any report; (e) your remediation, non-remediation, disclosure, non-disclosure, or other decisions or actions taken or not taken in reliance on any report; or (f) your violation of any applicable law or the rights of any third party.
10. Governing Law and Dispute Resolution
These Terms are governed by the laws of the State of Illinois, without regard to its conflict of law principles. Any dispute arising out of or relating to these Terms or the Service shall be resolved exclusively in the state or federal courts located in Cook County, Illinois, and you consent to personal jurisdiction in those courts.
11. Changes to These Terms
We may update these Terms from time to time. When we do, we will update the "Last Updated" date at the top of this page. Continued use of the Service after updated Terms are posted constitutes your acceptance of the changes. We will make reasonable efforts to notify users of material changes.
12. General
Entire Agreement. These Terms, together with our Privacy Policy, Refund Policy, Acceptable Use Policy, Disclaimers, and Free Scan Terms, each as updated from time to time in accordance with their terms, constitute the entire agreement between you and SiteScanReport LLC regarding the Service and supersede all prior and contemporaneous understandings, agreements, representations, and communications relating to the Service.
Severability. If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
No Waiver. Our failure to enforce any provision of these Terms does not constitute a waiver of our right to enforce it in the future.
